九月五號,多個勞工及人權團體到勞委會前抗議,將台塑六輕麥寮廠菲律賓外勞遭到毆打並強制遣返的事件向勞委會及社會大眾揭露;九月二十三日,我們並曾就同一事件到行政院陳情。遺憾的是,七個星期以來,勞委會從未對相關團體及社會大眾交代事件成因,亦未提供的任何調查報告。難道勞委會認為這是件他們可以充耳不聞的小事嗎?

台塑六輕麥寮廠嚴重侵害了在廠內工作的數千名外籍勞工的人權,我們絕不會因為勞委會的忽視而善罷干休。就在上週,台塑資方甚至還企圖說服廠內外勞另外簽下一紙附帶契約(side agreement),以將其不法的扣薪合理化,並將送請勞委會核准。

這份契約裡包括:
1. 入境台灣的文件手續費新台幣10,000元。
2. 仲介費。
3. 需要付給菲律賓仲介的剩餘款項。

一直到現在,台塑六輕廠外勞的加班費依然總是遲發。此處尚未列入廠內數量高達3,100人的泰籍外勞的薪資及扣除額內容。

事實上,導致七月十四、十五號兩天罷工的原因包括:1.外勞被違法扣薪;2.每月實際上只能拿到極少的生活費;3.完全沒有室內食堂;4.因為外勞實際能支配薪資極其有限,常向中鼎公司員工Jerry Tan經營的商店貸款,而這家店居然對每筆貸款收取10%利息,以及5.契約所載雇主與實際雇主不符。

廠區內的食堂直到一個月以前才蓋好;違法扣薪則因為台塑資方正在等待外勞簽訂上述附帶契約而暫停。而在其他幾項引起菲勞不滿罷工的導火線中,每月只付給外勞少許生活費這項措施,實際上就是將勞委會去年曾在去年大力倡導但後來因為勞工及人權團體強烈抗議而無限期延期的「外勞錢流管理系統」在法未頒佈的情況下悄悄付諸實行。而到底誰才是真正的雇主?為什麼外勞要為包括中鼎及三星在內的不同包商工作呢?這項措施合法嗎?勞委會認可嗎?

回到八月二日的毆打及強迫遣返事件,很清楚的,這其實是針對菲勞七月十四、十五日兩天正當罷工的鎮壓及報復。

我們提出以下幾點要求:

1. 調查並嚴懲這項卑劣之舉的幕後主使者以及實際打人的罪犯。
2. 對仍在台塑六輕麥寮廠內工作的目擊證人,保護他們免於台塑公司及其承包商的任何報復行為。
3. 對台塑六輕麥寮廠所發生的不公及非法事件組成調查委員會,並包括由我們推薦的非政府組織及個人代表。上述委員會應在正式開始調查一週前告知台塑六輕麥寮廠全體外勞,台塑公司並不得對任何外勞展開報復或監視。
4. 中鼎公司員工所經營商店應立即停止對外勞收取貸款利息。
5. 取消一切非法扣薪、取消一切附帶契約。

Render Justice to the Beaten Up Workers of Formosa Plastics Group!
Act on Their Legitimate Complaints!

It has been seven weeks since we have raised to the CLA and to the public the beatings of four Filipino migrants in Formosa Plastics Group (FPG) in Maliao, Yun Lin. Yet up to now the CLA has not provided the public or us any findings of their investigation on the incident and what caused it. Is this just a trifle matter for the CLA that it can only ignore?

We will not let them and the general public ignore this grave human rights and labor violations inflicted on the workers in FPG. Only last week, the FPG was trying to convince the remaining workers to sign a side agreement legalizing unlawful deductions on their pay, which would be submitted to the CLA for approval.

This include the following:
1. NT$10,000 documentary fee for entrance to Taiwan
2. Broker¡¦s Fee
3. Balance amount to be paid to the (Philippine) agent

It is also reported that at present, payment for the overtime of the workers is always delayed. We do not include here the impositions made on the Thai workers who comprise 3100 in number.

Essentially, what caused the strike in July 14 and 15 were the illegal deductions imposed on the workers; the giving out of only a measly monthly allowance to them; the lack of a mess hall; the imposition of a 10% interest on a loan in a store owned by Jerry Tan who works for CTCI and the non-implementation of their contract as to who really is their employer.

The mess hall has already been built a month ago and the illegal deductions have stopped for the meantime pending signing of the side agreement. With regards to the other two, in essence the giving out of allowances is in effect implementation of the Financial Management on Foreign Workers, which the CLA has tried to implement in the not too distant past. As to who really the employer really is, why do the workers work to different subcontractors like CTCI and Samsung among others? Is this legal and sanctioned by the CLA?

Going back to the beatings of the Filipino workers on August 2 in retaliation for their legitimate strike for two days in July, we demand the following:

1. Investigate and punish the perpetrators and those who ordered this dastardly act.
2. Provide witnesses still working in FPG immunity from any retaliation by the company or its subcontractors.
3. Conduct a fact-finding mission inside the FPG compound to include representatives of NGO¡¦s and individuals that we will recommend. This should be announced to the workers a week before the mission and there should be no retaliation or surveillance to be conducted by the company on them.
4. Stop the imposition of an interest in the store of CTCI
5. Stop all illegal deductions and annul all side agreements imposed on the workers.
