戰後六十年人權受侵害?犧牲一輩子!何時還我「人權、尊嚴、公道」? 六四 陪樂生老人前往總統府、立法院行動!

國民黨拿回政權,除了過去二二八及白色恐怖人權受害者,首先就是要面對另一批台灣最久的人權受害者樂生院民及全台尚存活1053位漢生病友。

去年底已大致商完成的「漢生人權保障法」,總統大選前國民黨團允諾樂生保留自救會及聲援的團體,將「馬上優先」完成「立法」。如今馬英九總統已經走馬上任入主「總統府」,立法院院會也將結束,然而「朝野協商沒聽說要召開」,法案至今還「文封不動」,但樂生院長李乃枢6月5日將開始ㄒ「發包工程」要求老人家搬家。

國際間高度關切這幾件事紛紛表達關切,聲援團體將在週三,也是六四這天前往總統府轉遞交「聯合國NGO組織COHRE & IDEA聯合聲明新聞稿」接著到立法院,將問馬總統及國民黨團如何處理全球興起高度關切漢生病人權議題?外交如何處理,未來政策方向?

今年一月底,第十七屆世界漢生病大會在印度舉辦,本次會議由印度政府及世界衛生組織WHO,ILA,ILEP,LIA,IDEA等國際組織主、協辦。大會宗旨強調「朝向一故無岐視漢生病人的世界邁進」。樂生院代表李添培先生獲邀在大會報告,進一步與IDEA數十各會員國結盟,監督各國從立法、司法、社會改革。

相對,「台灣漢生人權保障法」從2005年樂生院民對日本(台灣前政權)要求國賠勝訴,扁前總統也公開道歉,允諾立法保障漢生病人晚年,法案一推整整「兩年」,去年底法案衝刺要通過三讀前,卻因為立委選戰,被政治人物三振犧牲。

今年初,總統大選前立院「國民黨團」允諾,院會開始,「馬上優先」完成立法,正式向全台尚存活的1053位病友「道歉」「賠償」「保障晚年」等,還受害者公道。

然而法案在選前順利進入「朝野協商後可逕赴二讀」階段,選後馬英九總統已經順利拿回政權入主「總統府」,立法院國民黨團至今卻「文封不動」,「朝野協商遲遲沒聽說要召開」,院會又將結束,一再拖延,看不見誠意。

而另一方面6月5日樂生院新任院長李乃樞,已經巧巧為捷運局即將拆遷樂生院「工程發包」,引起樂生老院民一陣嘩然!「法案沒過」卻私下開始逼我們搬家,這算什麼?

六四(週三) 這天早上9:40,在台甫成立國際愛地芽協會(IDEA)在台分會及聲援團體將陪同樂生保留自救會成員將前往總統府遞交「聯合國NGO組織COHRE & IDEA聯合抗議新聞稿」。10:30隨後到立法院拜會民進黨團及國民黨團呼籲協助「停止工程發包」,「馬上,三讀漢生法案」公聽會!

樂生院及全台成千上萬漢生人權被隔離一輩子人權侵害問題,讓社會大眾體會,台灣從「日據」到國民黨政府,再到民進黨政權、如今國民黨再次取回政權,標榜「天下為公,人民最大」。

然而,政權一再移轉,何以八十年來,成千上萬「漢生病友」卻始終「被犧牲,沒有人權,沒有尊嚴」?想問問馬總統及立委諸公,「天下為公,人民最大」,未來漢生病政策要怎麼辦? 樂生院要不要保留?怎麼面對國際外交的觀感?

The Taiwanese government will be responsible for human rights violations if the Taipei County Government (TCG) goes ahead with the planned forced eviction of 80 residents of the Lo Sheng Sanatorium next month, warn the Geneva-based Centre on Housing Rights and Evictions (COHRE) and the International Association for Integration, Dignity and Economic Advancement (IDEA).

駐日內瓦國際居住權與反迫遷中心以及國際IDEA組織總部在此提出嚴正的警告,如果台北縣政府在下個月繼續執行強迫80幾位樂生院民搬遷的計劃,台灣政府必須要對這樣的人權背叛事件負責。

The Lo Sheng Sanatorium in Sinjhuang City, Taipei County, is the first and only national leprosy sanatorium in the Republic of China. The original 310 residents have been reduced to 80, following repeated eviction attempts since 2003 by the TCG for the construction of the Taipei Mass Rapid Transit System. The TCG plans to relocate the residents to the 5th and 9th floors of the newly-built high-rise Hui-Long Hospital, which is unsuitable for persons affected by leprosy as it does not provide an open space community and home-based model, as recommended by the World Health Organisation (WHO).

樂生療養院位於台北縣新莊市,是第一個也是中華民國唯一的國立漢生病療養院。由於從2003年(馬英九市長任內)開始台北縣政府為了建築捷運系統道路一次一次逐步迫遷使得原本有310位居民現在已經被減少到只剩80位。

Malavika Vartak, Coordinator of COHRE's Global Forced Evictions Programme, said, "The TCG's plans to evict the 80 residents of Lo Sheng Sanatorium will result in human rights violations. International law demands that governments and local authorities only evict in exceptional circumstances and after consideration of all possible alternatives to eviction. It is clear this has not occurred in the case of the residents of Lo Sheng Sanatorium. The planned forced eviction will not only deny the residents their basic human right to adequate housing, but also deprive persons affected by leprosy of easy access to facilities and thus the freedom of movement."

馬拉維卡.維坦,(聯合國)全球反迫遷計劃國際協調員談到:台北縣政府計劃迫遷80位院民是違背人權的行為。國際法邀求政府和地方當局只有在特定的情況下 或考慮過所有可行替代方案之後才可以進行迫遷。很明顯的,樂生情況並不符合上述情節。計畫性的強制搬遷不只是否定居民的基本人權也剝奪了痲瘋患者使用設施的便利性和遷移的自由。

Anwei Law, International Coordinator of IDEA, said, "It would be a tragedy if Lo Sheng residents, who were forcibly separated from their families many decades ago due to society's reaction to leprosy are evicted by force from their homes once again. Lo Sheng residents who have made the sanatorium their home for several decades find unacceptable TCG's plans to treat them as patients, rather than people who simply want to live out their lives in their home. We urge the Taiwanese government to ensure the human rights of persons affected by leprosy, specifically the right to life, dignity of the person, the right to health, equality before the law and freedom from inhuman or degrading treatment are fully respected."

安威.羅(Anwei Law),愛地芽國際協調員說,過去因為社會對痲瘋病的反應,使他們被迫離開家庭,現在如果又再一次被迫遷,對樂生的居民來說,這會是ㄧ個悲劇。對於把療養院當作他們的家數十年來居住在這裡的居民來說,他們不能接受台北縣政府的計畫,把他們當成是病人,而不是只是想要生活在自己家園的人。我們極力地呼籲台灣政府保障痲瘋病人的人權,特別是生活的權利、個人的尊嚴、健康的權利,在法律之前平等、免於非人道或不周到的照護,並得到完全的尊重。

The International Covenant on Economic, Social and Cultural Rights (ICESCR) guarantees the right to adequate housing, including the prohibition of forced evictions, in Article 11 (1), which obliges governments not to interfere with persons who enjoy some level of housing, as well as to protect people from forced evictions undertaken by third parties, including State and Municipal authorities.

ICESCR在第十一章(1)說明保障居住的權利,包括禁止強制搬遷,要求政府不能干涉個人享有基本居住自由,同時保護人們免於來自國家或市政府的強制迫遷,

Jean du Plessis, the Deputy Director of COHRE, said, "Given Taiwan's stated commitment to uphold human rights principles, we urge the new President-elect, Ma Ying-jeou, and the Taiwanese government to suspend implementation of the planned relocation until such time as appropriate alternatives have been agreed on by the affected parties. It is essential for the government to carry out in-depth consultations with the residents of Lo Sheng Sanatorium and to fully explore the alternative plan submitted by the Council for Cultural Affairs (CCA), which was carried out in consultation with the residents of Lo Sheng Sanatorium. Failure to do so will amount to human rights violations."

Jean du Plessis全球反迫遷計劃的代表說,對於承諾要提升人權保障的新政府,我們呼籲新任總統馬英九和台灣政府暫停(捷運)施工和計畫性搬遷,直到適合的替代方案得到雙方的共識。

The CCA plan would retain as much as 90 percent of the sanatorium's heritage-buildings allowing for the residents to continue living in , while making way for the construction of the Mass Rapid Transit System. The plan produced by a local subsidiary of the UK-based Mott MacDonald Group, was rejected by the TCG in February 2007.
