反對資本主義全球化,對抗打壓勞工、污染環境的惡質辜氏企業!

繼年興紡織、臺南企業之後,又爆發一場台商在國外的勞資爭議。

位於美國奧克拉荷馬州龐卡市的大陸碳煙公司的勞工,面臨資方無預警「鎖廠」的惡劣打壓,已經失去生計長達一年又一個多月了,而這樣惡劣的資本家,正是在日本殖民時代當「台奸」、甚至壟斷鹽、糖、鴉片產業、從事「慰安婦」的仲介而惡名昭彰的辜家。以辜振甫為首的和信集團旗下的中橡公司是台灣唯一的碳煙廠商,在台灣享受政府長期的保護與補貼,並透過壟斷性的市場保護獲取暴利。大陸碳煙公司就為辜氏財團旗下的台泥和中橡公司所擁有。

自從辜家在 1995年收購大陸碳煙公司之後,就不斷地壓低勞工工作條件,苛刻到甚至連工人在工作後清洗身體時間的工資都不願意給。而面對資方無理要求的勞工,在和資方協商勞資合約的過程中,資方卻突然毫無預警地以「鎖廠」的手段撕毀與勞工的合約、對付工會,「鎖廠」即是雇用非工會的勞工入廠繼續生產,等於是讓勞方完全失去和資方談判的籌碼,可說是資方打壓勞資談判的利器。

此外,因為該公司生產的碳煙微粒具有穿透性,會引起嚴重的呼吸系統疾病,所以生產線上的勞工就是直接的受害者,並且在生產過程中也會對環境會產生嚴重的污染,辜家更長期漠視當地環保法規、在水源區排放廢水、傾倒廢棄物。大陸碳煙公司的諸多污染環境、打壓勞工的惡行,在當地引發了居民強烈反彈。

和大陸碳煙公司同屬和信集團的達和公司,近日也引發雲林縣林內鄉居民的強烈抗議,因為該公司興建的焚化爐將嚴重污染供應彰化、南投、雲林、嘉義四縣的淨水場與當地生產供應台北的稻蔬水果。而興建焚化爐也不只污染環境,在裡面工作的勞工也和大陸碳煙廠的勞工一樣,面對的是最骯髒的勞動環境。因此,我們可以看到辜家為了圖利,無論對國內或國外的環境和勞工,都「一視同仁」地剝削、破壞。在台灣有很多草根組織也展開了針對辜氏財團長期以來漠視環保、欺壓勞工的抗爭,我們可以看到,台灣與美國的弱勢者是站在同一條戰線上共同面對惡質的辜家財團的,因此,我們願意結合勞工和環保團體,共同來全力聲援大陸碳煙廠的勞工!

在資本主義全球化的浪潮之下,類似辜家這種惡質財團引發的國內外勞資爭議將層出不窮,我們認為,在台灣展開的抗爭除了展現「跨國勞工相挺」的意義之外,我們也可以從大陸碳煙的案例看到台灣勞工即將面臨同樣的遭遇,看到我們接下來抗爭的焦點之一也就是勞動三法的修法。

現在,台灣的勞動三法正在朝向「改惡」的方向修法,其中,勞資爭議處理法將賦予資方「鎖廠」的合法性,這樣等於片面地廢除了勞方的罷工權,讓原本就處於弱勢的勞工更毫無招架之力。倘若這樣的修法通過,日後台灣勞工將會遭遇和大陸碳煙的勞工一樣的命運。另外,政府打擊工會的修法還包括工會法中開放「自由入會」和勞資爭議處理法中限制「電信、大眾運輸、公共衛生、石油煉製、醫院、燃氣事業」的罷工權等,政府這種修法行徑等於完全地成為跨國財團的打手!政府對於大陸碳煙案的不聞不問,更是表明了站在辜家這種惡劣財團那一邊!

倘若政府修法通過,台灣的勞工將面臨和大陸碳煙廠工人相同的處境,因此我們也希望大陸碳煙工會、PACE工會、和ICEM工會能夠對台灣政府這樣的修法趨勢表達強烈的抗議,也藉此讓台灣基層工人瞭解到修法問題的嚴重性;台灣的總工會也應該以上述勞動三法改惡和環保運動的訴求作為動員台灣勞工的訴求點,讓台灣的勞工明瞭台美勞工跨國相挺的實質意義,這樣也才能夠讓這場抗爭有更多基層勞工的參與。

此外,我們也認為除了以股東會作為抗爭的焦點之外,我們更希望能夠喚起基層工人或其他草根組織對大陸碳煙勞資爭議的重視,但是這幾次的動員模式仍是以「友情贊助」為主,很難真的拉到基層的工會或環保組織,所以我們也希望總工會能夠勤於做基層的組織教育,向工人揭露勞動法令改惡的事實。

我們在此呼籲辜氏財團,立即停止惡劣的鎖廠行為,尊重勞工最基本的團結權和協商權,恢復和大陸碳煙廠工會的談判,否則我們將會繼續串連更多的勞工和環保組織,讓辜氏財團面臨國內外勞工運動和環保運動的聯手反擊!最後,我們向大陸碳煙廠的工人和聲援他們的工會、環保和社區團體持續一年多的抗爭表達最高的敬意,希望今後台美基層力量的串連能夠讓大陸碳煙的抗爭獲得圓滿的結果!

Against Capitalist Globalization! Against the Corrupt Koos Group that Oppresses Workers and Pollutes Environment! A Solidarity Letter from Focus on Globalization and Coolloud Web 2002/6/26

After two cases of Nien Hsing and Tainan Enterprise, once again, we witness a labor dispute involving Taiwan investment abroad. Facing the management’s lock-out policy without prior notice, the workers of Continental Carbon Company (CCC), located just south of Ponca City, Oklahoma, have lost their livelihood for more than 13 months. In this case, the corrupt capitalist is just the notorious Koo family, who monopolized the salt, sugar and opium industries, and even profited from the trafficking of “comfort women” under Japanese colonial rule. China Synthetic Rubber, a subsidiary company of the Koos Group (headed by Koo Chen-fu), is the only carbon company in Taiwan. It has made vast profits from the government’s protection and subsidies and the monopolized market. CCC is owned by Taiwan Cement and China Synthetic Rubber, two subsidiary companies of the Koos Group.

Right after the Koos Group acquired CCC, it worsened the working conditions to the extent that it wouldn’t pay for the time that workers use to take a shower after work. What’s worse is that the management adopted the lock-out policy without prior notice during the process of negotiation. Lock-out means that the management employs those who don’t belong to the trade union, and thus the workers lose their bargaining chips.

Furthermore, the carbon black it produces is hazardous to human respiratory system (so the workers on the production line are the direct victims), and the environment is contaminated during the production. For a long time the Koos Group has also disregarded local environmental laws, including discharging hydrocarbon contaminated wastewater and dumping industrial waste. These bad deeds of CCC have led to strong local protests.

Here in Taiwan, the Ta-Ho Environmental & Technical Services Co., Ltd, also a subsidiary company of the Koos Group, has recently caused protests in Yunlin County, because the incinerator it builds will seriously pollute the water treatment facilities in Changhua, Nantou, Yunlin, and Chiayi, and the vegetable and fruit produced there as well. Building an incinerator will not only pollute the environment but also do harm to the workers who work inside the incinerator. As a result, we can see that in order to make profits, the Koos Group exploits workers and environment both at home and abroad. Since many grass-root organizations in Taiwan have protested against the Koos Group, we know that the underprivileged in Taiwan and the U.S. must fight a common struggle. So, we are very willing to align ourselves with labor movement and environmental organizations to support the workers of CCC!

In the era of capitalist globalization, international labor disputes such as the Koos Group case are piling up. We are of the opinion that the protests taking place in Taiwan not only shows the solidarity between global workers, but also let us understand more about workers in Taiwan, by which we mean the focal controversy about the revision of the three main labor laws.

Now, the three main labor laws are being revised to the detriment of workers. The new draft amendment to the Settlement of Labor Disputes Law will legitimize the management’s lock-out, and this can be viewed as negating workers’ right to strike. If this kind of revision is realized, Taiwan workers will face the same problems as workers of CCC do. Besides, other reactionary revisions of labor laws involve the Labor Union Law(allowing workers to make their own decisions on joining workers' unions)and the Settlement of Labor Disputes Law(restricting the right to strike in the telecommunication, mass transportation, public health, petroleum refining, hospital, and gas system). By doing so, the government will become the bodyguard of transnational corporations!

Therefore, we also hope that the union of CCC, PACE, and ICEM could protest against Taiwan government’s revision of labor laws in order to make Taiwan workers understand the severity of amending labor laws and the importance of solidarity with workers abroad. The TCTU and CFL in Taiwan should also protest against the above-mentioned problems of labor laws and environmental pollution to mobilize basic-level workers. What really counts is the mobilization of grass-root workers and unions, but so far the pattern of the protest mobilization is limited to “friendly support” and cannot really bring most workers and grass-root organizations into action. So we really hope that TCTU can dedicate itself to organizing and educating grass-root workers.

Here we must make public appeal to the Koos Group:

Stop the lock-out, respect workers’ rights of association and negotiation, and reopen the negotiation with the union! Otherwise, we will continue aligning ourselves with more labor and environment organizations and make large-scale protests!

Finally, we would like to express our deep respect for the workers of CCC and those unions and organizations that have supported them for more than a year. We hope the rank-and-file international solidarity between Taiwan and US will eventually succeed!
