 <title>Press Release and Report of Fact-Finding Mission to Sabah, Malaysia</title>

&lt;p&gt;This is one of the conclusions drawn by an eleven-people team that went for a fact finding mission to Sabah, Malaysia last June 11-16, 2009.&lt;/p&gt;
&lt;p&gt;Organized by the Asia Pacific Mission for Migrants (APMM) together with Tenaganita of Malaysia and Migrante International of the Philippines, the fact finding mission aimed to know the real situation of undocumented migrants living and working in the Sabah state, check on the developments with regard to the joint initiatives of the Malaysian government with Indonesian and Philippine governments in addressing this issue, and look into the situation of undocumented Indonesians and their need for education.&lt;/p&gt;
&lt;p&gt;“On top of the fact that it has not ratified the International Convention on the Protection of Migrant Workers and Their Families, the Malaysian government has not only cracked down on migrants but have virtually permitted several questionable practices: physical abuse by government authorities, corruption and bribery, human trafficking, child labor, and bonded or slave labor,” stated Aurelio Estrada, APMM desk coordinator for undocumented migrants and one of the mission’s participants.&lt;/p&gt;
&lt;p&gt;This conclusion, said Estrada, came from the interviews they have made with more than 100 migrant workers and their families in Kota Kinabalu, Sandakan and Tawau. Sabah is noted to have the biggest population of both Indonesian and Filipino migrants.&lt;/p&gt;
&lt;p&gt;The mission criticized both the Indonesian and Philippine governments for doing little in addressing this concern. While the Indonesian consulate has remained inconsistent in solving the migrants’ complaints, the Philippine government contests the political claim to Sabah as a reason not to establish a permanent office there to assist migrants.&lt;/p&gt;
&lt;p&gt;Both these governments, added Estrada, have aggressively implemented the labor export program with Malaysia being one of their top country destinations.&lt;/p&gt;
&lt;p&gt;The mission also pointed out the case of migrant workers who were unpaid and made to bonded labor in See Hoy Chan Plantation in Lahad Datu. By pursuing the case and exposing the migrants’ situation to the media, it has forced the Philippine government to provide support to the Filipino migrants.&lt;/p&gt;
&lt;p&gt;Aside from APMM, Tenaganita and Migrante, the other participants of the mission came from a wide variety of backgrounds: Cong. Luz Ilagan of Gabriela Women’s Party in the Philippines, Rey Asis of the Asia Pacific Students and Youth Association (ASA), Baseer Naweed of the Asian Human Right s Commission, Tony Salcedo of Osan Migrants Center in South Korea, Amy Sim from Hong Kong University and Fajar Kurniawan from Lumbaga Banduan Hukum, a lawyer’s group in Indonesian.&lt;/p&gt;
&lt;p&gt;The mission’s report revealed plans to engage with The Association of South East Asian Nations (ASEAN) to immediately and concretely address the situation of undocumented migrants, particularly in Malaysia. The report (attached to this press release) will be submitted to them in the upcoming meetings of the ASEAN.&lt;/p&gt;

 <title>“Stop the cover up, do your job.” APMM hits DFA for neglect of Sabah 15</title>

&lt;p&gt;This was declared today by Gi Estrada, program coordinator of the Asia Pacific Mission for Migrants (APMM) following claims by the Department of Foreign Affairs that they have been providing assistance to 15 Filipino workers victimized by bonded labor at the palm oil plantation See Hoy Chan Company in Lahad Datu, Sabah.&lt;/p&gt;
&lt;p&gt;“It is contemptible for the DFA to convolute the facts and vilify APMM and Gabriela Women’s Party for exposing the dire situation of the starving and exploited workers. They were never there, they never took into account the concerns of the workers, and they never lifted a finger until their office was under public fire. It’s a barefaced lie for the DFA and the Philippine Embassy in Malaysia to say that they’ve been helping the OFWs from the start,” he remarked.&lt;/p&gt;
&lt;p&gt;Estrada belied the DFA’s claim of assistance to the workers. According to him, APMM first faxed and emailed the complaints of the OFWs to the Philippine Embassy in Kuala Lumpur on April 29 which the Embassy did not acknowledge. (It is attached for your perusal)&lt;/p&gt;
&lt;p&gt;On May 24, the workers informed APMM that Mr. Gangco T. Punguinaguina, Consular assistant in-charge of ATN, had contacted them by phone and told them that they would be reported to Malaysian immigration and police officials and would be sent home. Punguinaguina also told the workers that they should take care of their airfare and discounted penalty fee for those who have no work permits and were considered as overstayers.&lt;/p&gt;
&lt;p&gt;Estrada reported that he personally called up Mr. Punguinaguina who said that the OFW’s cannot file&lt;/p&gt;
&lt;p&gt;a labor case because the OFW’s did not pass through the Philippine Overseas  Employment Administration (POEA). That is the reason why Butch Pastolero, one of the complaining workers, was reluctant to provide the ATN official the numbers of the company management because they wanted the company to compensate them properly for their work.&lt;/p&gt;
&lt;p&gt;“We talked directly to the workers during the Fact-Finding Mission we conducted with other groups like Gabriela from June 11 to 16 to ascertain their condition – something the Philippine Embassy never did. No negotiation was ever conducted by the company with the workers, Ambassador Lecaros never talked to the distressed workers, and the touted presence of Philippine consular officials in Sandakan and Sarawak – which is still a plane ride away from Lahad Datu – never did anything,” he relayed.&lt;/p&gt;
&lt;p&gt;Additionally, Estrada hit the DFA for even defending the exploitative practice of the said company. The DFA’s press statement yesterday claimed that the workers have an employment contract that stipulates that their wages would be from RM800 (P10,902) to RM1,000 (P13,627) per month based on their individual output. But they were paid less allegedly because they were not able to reach the quota set by the company.&lt;/p&gt;
&lt;p&gt;Based on the worker’s account to APMM, the highest that any one of them got was RM500 (P6,814). But this was deducted by RM125 (P1703) for the levy and work permit and a further minimum of RM200 (P2725) for the food and other supplies that they loaned from the company run-store. In effect, their take home pay was only RM175 (P2,385). There were times that they were paid only RM100 to RM300 a month which meant that their debt was greater than their wages.&lt;/p&gt;
&lt;p&gt;“Isn’t this bonded labour that even international laws prohibit? Instead of sounding like the spokesperson of the company, should not the DFA and Embassy assist in claiming the wage arrears of the workers? Undocumented or not, it is the foremost responsibility of the Philippine government to help any distressed overseas Filipino,” he added.&lt;/p&gt;
&lt;p&gt;Estrada said that they will closely monitor the promise of the DFA and the Embassy in Kuala Lumpur to go to the plantation this Thursday to take the workers. He also added that Philippine officials promised that nobody will be detained by Malaysian Immigration and police officials and that they would take care of all their expenses up to Iloilo.&lt;/p&gt;
&lt;p&gt;“It is not enough to just send them home as if no crime against the OFW’s were done against them by their employer and by their illegal recruiter. The government should assist the workers in getting the justice and compensation from the recruiter and from the employer that the OFWs rightfully deserve,” he concluded.&lt;/p&gt;

&lt;p&gt;Estrada reported that he personally called up Mr. Punguinaguina who said that the OFW’s cannot file&lt;/p&gt;
&lt;p&gt;a labor case because the OFW’s did not pass through the Philippine Overseas  Employment Administration (POEA). That is the reason why Butch Pastolero, one of the complaining workers, was reluctant to provide the ATN official the numbers of the company management because they wanted the company to compensate them properly for their work.&lt;/p&gt;
&lt;p&gt;“We talked directly to the workers during the Fact-Finding Mission we conducted with other groups like Gabriela from June 11 to 16 to ascertain their condition – something the Philippine Embassy never did. No negotiation was ever conducted by the company with the workers, Ambassador Lecaros never talked to the distressed workers, and the touted presence of Philippine consular officials in Sandakan and Sarawak – which is still a plane ride away from Lahad Datu – never did anything,” he relayed.&lt;/p&gt;
&lt;p&gt;Additionally, Estrada hit the DFA for even defending the exploitative practice of the said company. The DFA’s press statement yesterday claimed that the workers have an employment contract that stipulates that their wages would be from RM800 (P10,902) to RM1,000 (P13,627) per month based on their individual output. But they were paid less allegedly because they were not able to reach the quota set by the company.&lt;/p&gt;
&lt;p&gt;Based on the worker’s account to APMM, the highest that any one of them got was RM500 (P6,814). But this was deducted by RM125 (P1703) for the levy and work permit and a further minimum of RM200 (P2725) for the food and other supplies that they loaned from the company run-store. In effect, their take home pay was only RM175 (P2,385). There were times that they were paid only RM100 to RM300 a month which meant that their debt was greater than their wages.&lt;/p&gt;
&lt;p&gt;“Isn’t this bonded labour that even international laws prohibit? Instead of sounding like the spokesperson of the company, should not the DFA and Embassy assist in claiming the wage arrears of the workers? Undocumented or not, it is the foremost responsibility of the Philippine government to help any distressed overseas Filipino,” he added.&lt;/p&gt;
&lt;p&gt;Estrada said that they will closely monitor the promise of the DFA and the Embassy in Kuala Lumpur to go to the plantation this Thursday to take the workers. He also added that Philippine officials promised that nobody will be detained by Malaysian Immigration and police officials and that they would take care of all their expenses up to Iloilo.&lt;/p&gt;
&lt;p&gt;“It is not enough to just send them home as if no crime against the OFW’s were done against them by their employer and by their illegal recruiter. The government should assist the workers in getting the justice and compensation from the recruiter and from the employer that the OFWs rightfully deserve,” he concluded.&lt;/p&gt;

&lt;p&gt;According to the Asia Pacific Mission for Migrant Workers (APMM) and the Gabriela party list, the 15 workers of Hoy Chan Plantations in Jalan Jeroco, Sabah are also at risk of dying of hunger after their employer stopped them from getting food from the company store.&lt;/p&gt;
&lt;p&gt;The OFWs have been in the company from December 2008 and March 2009. They are Joenel Caro, Roland Casis, Nelio Casquejo, Ruben Cortel, Moisis Cortel, Michael Duran, John Mark Libuna, Vicente Libuna, Rene Lim, Ariel Lorena, Ian Rey Lorena, Butch Pastolero, Quizy Pastolero, Romeo Pedregosa, and Zandro Camda. They started work at the company at different times between December 2008 and March 2009.&lt;/p&gt;
&lt;p&gt;They said no Philippine government agency was attending to the plight of the 15 undocumented OFWs.&lt;/p&gt;
&lt;p&gt;Gabriela party list Representative Luz Ilagan, who joined the mission in Sandakan, Sabah and Kota Kinabalu, said the OFWs are victims of “bonded slavery” because their situation: They are being held by the employers, they are required to work more hours than legally allowed, they are paid very low wages, and they do not have any social security benefits, among others.&lt;/p&gt;
&lt;p&gt;And the APMM agreed. “The employer should be investigated for practicing bonded labor. Such kind of practice which is akin to slavery is prohibited under international law,” it said.&lt;/p&gt;
&lt;p&gt;Ilagan also pointed out another complication to the situation of the 15 workers, and those in similar dire straits. She said Sabah, which is claimed by both the Philippines and Malaysia, does not have a Philippine government office which could attend to Filipino workers.&lt;/p&gt;
&lt;p&gt;“The problem is the structure is not clear as who should assist these workers. We don’t have an embassy in Sabah because of the claims dispute of the land,” she said in a phone interview.&lt;/p&gt;
&lt;p&gt;She said most workers in Sabah’s palm oil plantations have stayed there beyond the limit allowed by the Malaysian government because they could not afford the renewal fee of their passport.&lt;/p&gt;
&lt;p&gt;In a separate statement, the international workers&#039; alliance Migrante urged the Arroyo administration to send a rescue mission to the 15 workers being held in the palm oil plantation.&lt;/p&gt;
&lt;p&gt;“The OFWs are being held against their will without any food in retaliation for their refusal to work due to inhuman conditions in the plantation.  <title>Fifteen OFW’s in Sabah Prevented from Getting Food Supplies</title>

At the same time we are disturbed by the Philippine Embassy’s contention that this cannot be a labor case because the OFWs did not pass through the Philippine Overseas Employment Administration (POEA) and that the only recourse left for them is that they be repatriated and deported back home.&lt;/p&gt;

&lt;p&gt;Subsequent communications with the workers and a visit to them in Sabah by a Fact Finding Mission team of NGO’s led by APMM and Tenaganita on June 14 revealed that their conditions are far worse. Essentially they are in debt bondage as they are paid between RM100 – RM500 a month but are deducted RM125 a month for a levy and work permit and another RM200 plus for food and other supplies in a store owned by the company. An additional RM200 was deducted from each of them for their working tools. Their conditions are similar to the exploitative conditions of Sacadas in Negros.&lt;/p&gt;
&lt;p&gt;The FFM team was able to get documents from the OFWs on their exploitative conditions in See Hoy Chan Plantations in Jalan Jeroco, Sabah. In May, one group of 6 workers were paid by the company RM2587 but were deducted RM1744 for their food and other supplies from a company owned store. What was left was an average of RM140.5 (P1931) each. Their take home pay should have been an additional RM49 each but these were deducted as well from their wages.&lt;/p&gt;
&lt;p&gt;Under Malaysian regulations, employers are allowed to deduct 50% of the levy from their foreign employees Most of the workers except for one named Butch Pastolero have no work permits yet even these are being deducted from them.&lt;/p&gt;
&lt;p&gt;The workers have decided not to work on June 17 when the company told them that they cannot get any food and other supplies from the store inside the plantation. The Philippine Embassy should rescue them and assist them to be properly compensated for their work; get a refund of the payment they made for the levy which was pegged by the employer at RM1800 instead of RM600 and for other illegal deductions; repatriated back home free of charge; and assist the workers in filing a case against the employer for bonded labor. The Embassy should also go after the illegal recruiters who recruited the workers in the Philippines and charged accordingly.&lt;/p&gt;

 <title>59 Pinoys face death penalty abroad</title>

 <description>&lt;p&gt;&lt;strong&gt;MANILA, Philippines - &lt;/strong&gt;Fifty-nine Filipino workers languishing in various jails worldwide are facing the death penalty, the Department of Foreign Affairs (DFA) reported.&lt;/p&gt;
&lt;p&gt;Most of the cases involve several offenses such as rape, drug smuggling and homicide and are pending in China, Malaysia, Kuwait, Brunei, United States and Saudi Arabia, said Foreign Affairs Undersecretary Esteban Conejos Jr.&lt;/p&gt;
&lt;p&gt;“The cases of the 59 Filipinos are in different stages,&quot; Conejos added.&lt;/p&gt;
&lt;p&gt;Citing data from Philippine foreign posts, Conejos said there were a total of 87 Filipinos on death row since January 2006. Of the number, 28 were commuted. He added that 12 Filipinos already returned home after serving their prison sentences.&lt;/p&gt;
&lt;p&gt;Ten cases of Filipinos, who allegedly committed crimes punishable by death are still on preliminary investigation, while 49 are pending in courts.&lt;/p&gt;
&lt;p&gt;Conejos said 49 Filipinos are facing death for drug-related charges, mostly in Chinese jails. The good thing is that China has a two-year reprieve for foreign nationals with death sentences.&lt;/p&gt;
&lt;p&gt;“In China they have what they call suspended cases wherein the implementation of execution is suspended for two years so that in the event the detainee behaves properly in jail, it is commuted to life sentence. This allows them to credit good behavior in prison,&quot; Conejos said.&lt;/p&gt;
&lt;p&gt;The DFA has been actively campaigning to abolish or at least secure a moratorium on the death penalty in countries with jailed Filipinos.&lt;/p&gt;
&lt;p&gt;With more and more Filipinos facing the death penalty overseas, Party-list Representative Satur Ocampo, of Bayan Muna, wants to amend the existing Philippine laws and provide substantial legal services to overseas Filipino workers (OFWs) who are facing trial or languishing on death row. &lt;p&gt;Ocampo’s recently filed bill, House Bill 5657, seeks to expand the scope and upgrade the Department of Foreign Affairs (DFA) program to provide full legal assistance to migrant workers and overseas Filipinos in distress.&lt;/p&gt;
