We are one with the local workers in calling for an increase in the minimum wage for all working peoples in Taiwan and with all their just and legitimate demands. We also congratulate migrant workers worldwide who would join with their local brothers and sisters in celebrating Labor Day. In particular, we salute the migrant workers in the US for campaigning against the criminalization of millions of undocumented workers by the US government.
我們和當地勞工以合理合法的要求站在一起,請求提高所有台灣勞動人口的最低工資。我們向勞工們祝賀,世界各地的移工加入他們在地的兄弟姐姐們一起慶祝勞工節的到來。尤其向那些在美國幾百萬個被認定為非法勞工來抗爭的移工們致上我們的敬意。
In celebrating May 1st in Taiwan, we would want to stress that we are against the proposal of some sectors in government to de-link the compensation of migrant workers from the basic minimum wage. To do so would only further decrease the already very low basic pay migrants presently get because of numerous deductions from their salaries.
在台灣慶祝勞工節時我們強調,我們對將移工薪資從勞基法最低基本工資脫鉤的某些政府提案表示反對。由於各項薪水的扣除額,移工薪資與勞基法最低基本工資脫鉤只會更減少了移工目前已經非常低的基本薪資。
Instead we are calling on the authorities concerned to increase said的wage and to put a stop to the legal extortion勒索of the migrant worker’s pay, which the Taiwan government allows.
因此我們呼籲管理單位考慮增加其薪資,也停止台灣政府所核准對那些移工薪資的合法勒索。
If the salaries of the migrant workers were de-linked from the minimum wage, this would further cut their basic pay, which is already below the existing said wage. For the six year period they are allowed to work legally in Taiwan, Filipino migrant workers only receive an average basic pay of between NT$8086 – NT$12,086 a month or 51 - 76% of the existing minimum wage of NT$15,840.
如果移工薪資與勞基法基本工資脫鉤,這將會更進一步地削減掉他們已經比勞基法基本工資還少的基本工資。合法在台6年的工作期間,菲律賓移工每個月只得到8,086到12,086台幣的平均基本工資,或是57%-76%的現存最低工資(15,840台幣)。
The deductions扣除額, on the Filipino migrants wage for a 6-year period are as follows: 6年工作期間,菲律賓移工被扣除的薪資款項列舉如下:
1. Brokers service fees – NT$114,000 仲介服務費 2. Board and lodging fees for those covered by the Labor Standards Law (LSL) – NT$180,000 - NT$288,000 勞基法裡規定的食宿費- 3. Income tax (minimum) – NT$68,400所得稅 4. Labor insurance for those covered by the LSL – NT$14,832 勞基法裡規定的勞工保險 5. Medical insurance – NT$15,552 醫療保險 6. Air fare to and from Taiwan (2x) – NT$13,300 來回台灣機票費 7. Alien Residence Certificate – NT$6,000 外國人居住証明 8. Medical check –ups – NT$12,000 健康檢查 9. Additional placement fee and documentation costs after the first three years of work – NT$26,209 前三年工作後額外的安置費 和 文件資料費
Indonesians are worse off as they are deducted扣除 up to a maximum of NT$6438 a month for 15 months or NT$96,570. This is payment for their placement fees in Indonesia, which is deducted in Taiwan through China Trust Bank. And this is paid twice, for the first three years of stay and for the succeeding additional 3 years. As such, they only have a basic wage of NT$5953 - NT$9952 a month for a 6 year period or only 38% - 63% of the minimum.
印尼移工的情況更糟糕,他們的薪水一個月最多可被扣除6438台幣或是15個月全加起來的96,570台幣。他們的在印尼的安置費用,在台灣是交由中國信託銀行扣除。這需要支付兩次,第一次是為了前三年的居留,第二次為附加的後三年。就此而論, 6年期間他們一個月基本薪資只有5,953-9,952台幣,或是說勞基法最低工資的38%到63%。
These do not include forced savings and illegal deductions on both and all other nationalities and the pegging of the minimum wage to a much lower level on some of those working in factories. Employers in this category peg the basic wage to as low as NT$10,000 a month and categorize other parts of the supposed minimum as bonuses for perfect attendance, good performance and even food allowance.
這還不包括強迫儲蓄和對菲律賓、印尼和其他各國移工的非法扣除額。對在工廠工作的移工,綁住最低工資朝向更低的收入水平。在這類雇主綁住移工基本工資讓它少到一個月才一萬塊,並且將基本工資的其它部分(15,840-10,000),列入全勤獎金、表現優異獎金甚至是加菜金。
And a number of migrant workers pay 20% or NT$3168 income tax if they arrive in Taiwan after July 1. Imagine how much would be their basic pay for their first 6 months if they fall under this category.
在七月一號後,為數眾多的移工在到達台灣後,付了薪資的20%或3168台幣的所得稅。如果他們在這工種分類之下,請想像移工們為了他們在台的前六個月要付出多少基本薪資?
We are thus calling for the following: 我們因此呼籲聲明如下:
1. Increase the minimum wage of the migrant and local workers of all job categories 增加所有移工與本勞在所有工種中的最低工資 2. Stop the legal extortion on the migrant workers pay and which are the following: 停止對所有移工薪資的合法勒索 a. Abolish the brokers’ service fee – The CLA has admitted that this is actually a management fee. It is preposterous that migrant workers should shoulder the management expenses of their employers. This is in fact absurd when this is imposed to those working in homes. 廢止仲介費-勞委會說明這是管理費用。移工應負擔雇主的管理費用這是荒唐的。當這政策加諸在家務勞動的移工上是荒謬的。 b. Exempt the migrant workers from the payment of income taxes especially since majority of them actually are paid lower than the minimum wage and many have dependents in their home countries. 免除所得稅—特別當多數移工的薪資低於最低工資,許多移工在母國還有許多嗷嗷待哺的人口。 c. The employers should shoulder miscellaneous expenses as payment for ARC, medical checkups and even for airfare to and from their home countries. 僱主應為移工的居留証支付雜費支出,包括健康檢查與來回母國的機票費。 d. The wage cut of those covered by the Labor Standards Law in the guise of payment for board and lodging should be abolished. The article in the LSL that legalizes this (i.e. wages can be made in kind should be scrapped) 勞基法合法保障薪資的條款卻以食宿費之名扣除的情事應允以廢除。 e. Pegging the minimum wage lower than NT$15,840 by dividing this into several categories such as perfect attendance, etc. should be declared illegal. Instead these should be treated as incentives pay. 藉種種名目將最低薪資綁在低於台幣15840的作法應宣告為非法。 f. Declare as illegal the practice of forced savings.將強迫儲蓄措施宣告為非法 g. Disallow the salary deductions on Indonesian migrant workers for 15 months through China Trust Bank (拒絕)不接受透過中國信託銀行扣除印尼移工薪資達15個月。 h. Labor and medical insurance should be shouldered by the employers and not on minimum wage earners. 僱主應負擔移工之勞健保。 i. Disallow the practice of payment for placement and documentation fees on rehires who just need to exit Taiwan after the first three years of stay and come back to their same employers (拒絕)不接受再僱用移工時,他們所要自行負擔的安置費與文件處理費--他們(被規定)在台三年後需離境,(才能)再回到原雇主 (再繼續合法地工作)。 3. Impose a salary cap on employers wishing to hire caretakers and domestic workers to ensure that they would be capable of paying their foreign workers. 對希望僱用家庭監護工與家務勞動者的僱主規定最低薪資標準 ,以確保僱主有償付薪資的能力 4. Abolish the levy on employers hiring migrant workers. 廢除僱主的雇用移工稅
In an editorial of Taiwan News, it stated that a 10 percent hike in the basic wage would only add 0.08 percent to total operating costs and an infinitesimal 0.019 percentage boost in the consumer price index. And that wages and benefits (account for only 13 percent of average operating costs). 一台灣新聞評論指出,若基本工資增加10%只會增加0.08%總體的操作成本,消費者物價指數微量增加0.019%。
It added that from 2001 through November 2006, the labor productivity index rose 34 percent while average monthly manufacturing wages rose only 10 percent, leading to an erosion of 19 percent in average unit labor costs compared to 2001.
從2001年到2006年11月,當製造業月平均工資只增加10%,勞動生產力指數上漲了34%;與2001年相比使得平均單位勞動成本降低了19%。
At the same time, we encourage the migrant workers to organize and mobilize themselves to protect their wages against these extortions legalized by the Taiwan government and to fight for an increase in the minimum wage. The experience of the 5000 Thai and Filipino workers in Formosa Plastics Company in Mailiao can be emulated. On their 3rd strike they were able to force their company to abolish payment for brokers’ service fees as long as they have no absences. Imagine what we can do if we mobilize in different factories and work places all over Taiwan at the same time in our tens of thousands.
同時我們鼓勵移工自我組織與動員來捍衛自己的工資,對抗台灣政府所合法化的勒索,加入最低工資的鬥爭行列。5000名泰國與菲律賓移工在Formosa Plastics Company in Mailiao的經驗值得跟進。在第三次罷工,他們迫使公司在沒有曠職的條件下,廢除仲介費。想像為數眾多的我們,在台灣的不同工廠與工作場所可以同時做些什麼。
