  《人口販運防制法》於2009年6月1日實施,該法的制定乃為防制人口販運並維護受害者權益。人口販運意指「意圖使人從事性交易、勞動與報酬顯不相當之工作或摘取他人器官,而以強暴、脅迫、恐嚇、拘禁、監控、藥劑、催眠術、詐術、故意隱瞞重要資訊、不當債務約束、扣留重要文件、利用他人不能、不知或難以求助之處境,或其他違反本人意願之方法,從事招募、買賣、質押、運送、交付、收受、藏匿、隱避、媒介、容留國內外人口,或以前述方法使之從事性交易、勞動與報酬顯不相當之工作或摘取其器官」。

  依人口販運防制法的定義,該法的涵蓋範圍廣泛且幾乎可以涵蓋台灣許多勞力相關的案件。然而,由於該法上路未久,其內容與移民及勞工相關規範亦有所重疊,因此在法律解釋及執行上便造成混淆以及勞動法律實務的挑戰。具體而言,在此引發的問題包括移工常遭仲介或僱主扣留證件是否符合人口販運防制法中的定義?答案若是肯定,該法要如何落實?落實的機制為何?移民或移工如何確保這部防制法能有效落實?台灣的民間團體或移民工服務單位又能如何促進該法的具體落實?

  還有更多問題值得移民工本身及民間團體、服務單位深入理解與澄清,以確保這部法律能夠協助台灣人口販運的被害人。有鑑於此,我們舉辦「勞動法律實務與人口販運」的公開座談與討論。

一、預期目標 本計畫的一般性目標是針對人口販運防制法與相關勞動法令的落實,提供資訊交流及深化理解的空間,並彙集各種觀點與建議,以確保在台灣的移民工能確實獲得法律的保障。

二、特定目標 1、 了解《人口販運防制法》的落實狀況; 2、 聽取來自台灣政府、學術界、草根移民工團體與民間團體對於人口販運防制與勞動法令與政策的立場。 3、 邀請至少五十位草根移民工組織與服務單位代表,共同討論並對政府相關單位提出具體的建議。

9:35 - 10:15 場次一:《人口販運防制法》當中針對勞力剝削的防治策略與機制 與談人: 1. 蔡孟良/行政院勞委會職訓局外勞聘僱管理組組長 說明台灣現行勞動制度下人口販運防制法執行現況,以及台灣目前保障移工權益的措施。

2. 張素紅/移民署移民事務組組長 說明人口販運防制法實施之後的現況發展,以及移民署提昇移民工服務的現行計畫。

3. 孫則芳律師、朱芳君律師/法律扶助基金會專職律師 說明人口販運防制法的法律機制與程序,以及對勞工的意義。

Seminar/Workshop on Legal Labor Practices and Human Labor Trafficking in Taiwan

Introduction/Background

The Anti-Trafficking Prevention and Control Act in Taiwan was promulgated last 23rd January 2009. According to Article 1 of this act, “This act is enacted to prevent human trafficking and to safeguard the rights of victims.

Accordingly, this act define human trafficking as “to recruit, trade, take into bondage, transport, deliver, receive, harbor, hide, broker, or accommodate a local or foreign person, by force, threat, intimidation, confinement, monitoring, drugs, hypnosis, fraud, purposeful concealment of important information, illegal debt bondage, withholding important documents, making use of the victim’s inability, ignorance or helplessness, or by other means against his/her will, for the intention of subjecting him/her to sexual transactions, labor exploitation or underpayment, organ harvesting; or to use the above-mentioned means to impose sexual transactions, labor exploitation or underpayment, or organ harvesting on the victims.

Reading through its definition, the act covers a wider scope and coverage which practically cover most of the common labor related cases in Taiwan under the anti-trafficking prevention and control act law.

However, since the law was passed recently and its coverage seems to overlap both immigration and labor related practices, it created an environment of confusion and challenges the legal labor practices in Taiwan in terms of its legal interpretations and implementation.

Concretely, it raises the question whether the confiscation of travel documents by brokers and/or employers are legal and fall under the definition of the anti-trafficking prevention and control act. If so, then how can this law be implemented and what are the mechanisms to implement this law? What is the role of migrants or foreign workers to ensure that this law is effectively implemented? And how Civil Society Organizations or Service Providers in Taiwan can contribute to the implementation of this law?

There are more questions and clarifications that migrants themselves and the communities including Civil Society Organizations and Service Providers need to understand in order to ensure that this law will benefit the trafficking victims in Taiwan.

It is in this regard that the idea of holding a public forum and workshop on the legal labor practices and human labor trafficking in Taiwan was conceived.

General Objective

The general objective of this project is to provide a space for information and deeper understanding on the implementation of the anti-trafficking prevention and control act vis-à-vis the labor law mechanisms in Taiwan and to gather observations and recommendations to ensure genuine implementation and accessibility of the legal system among migrants in Taiwan.

Particular objectives

1. To understand the actual implementation of the anti-trafficking prevention and control act; 2. To hear from different sectors including the Taiwan government, academe, grassroots migrants and civil society groups about their position on the anti-trafficking prevention and control act vis-à-vis the labor law mechanisms; 3. To gather at least 50 leaders of grassroots migrant organizations and its service providers and to come up with a list of recommendations for submission to the Taiwan government.
